These terms are an agreement between you and [Company legal name], [Registered address] ("Daynup", "we", "us"). They cover the Daynup app for iPhone and iPad, the booking pages we host for businesses, and this website. By creating an account or using Daynup, you accept them. If you use Daynup for a business, you accept them for that business too, and confirm you're allowed to. Our Privacy Policy explains how we handle personal data.
The short version
- Daynup is a tool for running your bookings. Your services, prices and promises to your clients are your own.
- Every plan starts with 14 days free, Daynup AI included, and no card is needed.
- Subscriptions renew until you cancel. In the app, you pay and cancel through Apple's App Store.
- The AI suggests and you decide. It can be wrong, and nothing changes until you confirm.
- Only contact people who expect to hear from you. No spam.
- Delete your account in the app at any time, with 30 days to change your mind.
01Using Daynup
To have a Daynup account, you must be 18 or older, or an adult where you live, and use Daynup for your work: taking bookings for your own business or one you work in. People who book through a booking page don't need an account. Section 11 is for them.
02Your account and your team
You sign in with Apple or Google. One login is for one person. Keep your devices secure: you're responsible for what happens in your account, and if you think someone else is using it, tell us at [email protected].
If you own a business on Daynup, you can add colleagues and decide what each of them can do. You're responsible for the people you add, and for removing them when they leave. If you join someone else's team, the business owns the bookings and client records you work with.
03The free trial
Every new account gets 14 days of Daynup with everything included, Daynup AI too. You don't need a card to start, and nothing is charged when the trial ends. There's one free trial per person.
When the trial ends, choose a plan to keep the features that need one. If you don't, your booking page keeps working and nothing is deleted.
04Plans and payment
Daynup has a Solo plan for one person, a Team plan priced by the number of colleagues who take bookings, and Enterprise for groups and chains, which comes with its own terms. Daynup AI is an optional add-on for the whole business. You can pay monthly or yearly. Prices are shown on our website and in the app before you pay, and taxes may be added where they apply.
In the app, you pay through Apple's App Store. Apple charges you, renews your subscription and handles refunds, under Apple's terms. On our website, where we offer it, you pay through our payment provider, [Web payment provider], under its terms. We never see your full card details.
When you add or remove colleagues on a Team plan, you see the new price before you confirm. How the change is charged follows the rules of the store or payment provider you pay through.
If we change our prices, we'll tell you in advance. A new price applies from your next billing period, and where the App Store asks for your agreement, it applies only once you agree.
05Renewals, cancelling and refunds
Subscriptions renew automatically at the end of each month or year until you cancel. To avoid the next charge, cancel at least 24 hours before the current period ends. For App Store subscriptions, go to iPhone Settings → your name → Subscriptions. Deleting the app, or your Daynup account, doesn't cancel an App Store subscription.
After you cancel, you keep your plan until the end of the period you've paid for. We don't refund partial periods, except where the law or the store you paid through requires it. Refunds for App Store purchases are handled by Apple.
06Daynup AI and fair use
Daynup AI adds the assistant, typed or by live voice, for everyone on your team, and AI help that answers your clients on your booking page. Each month it includes an allowance shared by your team: 300 assistant requests, 60 minutes of live voice and 600 client questions for your business, plus 100 requests, 20 minutes and 200 questions for each colleague. If you reach it, the AI pauses until the next month and everything else keeps working. The allowances are the ones on our pricing page when you subscribe.
Without Daynup AI, you can use the assistant 20 times a month, and setting your hours by talking is part of every plan.
To keep Daynup fast and fair for everyone, we also set short-term limits, such as how long one live talk can last and how many questions one phone number can ask a business's AI help in a day. Please don't use the AI with scripts or automation, or resell it.
AI can be wrong. The assistant only suggests changes, checked against your bookings, and nothing is saved until you confirm, so look at what it proposes before you do. The AI help on your booking page answers from what your page shows and your note for it, so keep your note accurate. It can't book, move or cancel anything, and it may sometimes give an incomplete or wrong answer. AI help for your clients is in beta: it may change, and we may pause it.
07Your booking page and your clients
Your business is yours to run. You're responsible for your services, prices, hours, booking rules and cancellation policy, and for keeping the bookings you accept. The agreement for your service is between you and your client. Daynup isn't part of it, doesn't take payment for your services, and takes no commission.
Keep your page honest and up to date, and only offer services you're allowed to offer where you work. You decide who can book. When new people are asked to confirm their number, Daynup sends them a code by WhatsApp or text message. Delivery depends on phone carriers and on WhatsApp, so we can't promise that every message arrives.
Health and care businesses: Daynup isn't designed to hold medical or clinical records and isn't built to meet HIPAA requirements, and we don't sign business associate agreements. Keep clinical notes in a system made for them, and only put in Daynup what you need to run your bookings.
08Contacting your clients
Only add people who are your clients or who have asked to book with you, and only contact people who expect to hear from you. You're responsible for having the right to keep and contact the people on your client list, and for following the laws on calls, texts and email where you and they are. In the US these include the TCPA and CAN-SPAM; in the UK and EU, data protection and e-privacy laws.
Messages Daynup sends for you, such as phone codes and booking reminders when you turn them on, are only about bookings. Don't use Daynup to send marketing, and don't add people from your contacts to message them about anything else. Texts like "running late" or a link to move a booking open in your own Messages app, and you're the one who sends them.
09Your content
Your business details, services, notes, client list and everything else you add stay yours. You give us permission to host, copy, process and show them only as needed to run Daynup, for example to show your booking page to the people you share it with. You're responsible for having the right to use what you add, including your clients' details.
We handle your clients' data on your behalf as our Privacy Policy describes, and we'll sign a data processing agreement on request. Want a copy of your data? Write to us. If you send us ideas or feedback, we may use them without owing you anything.
10Acceptable use
Please don't use Daynup to:
- break the law, or offer services that aren't allowed where you offer them;
- send spam, harass anyone, or contact people who haven't agreed to hear from you;
- use phone codes or reminders for anything but real bookings, or enter numbers that aren't the booker's own;
- mislead people with fake services, prices or identities;
- publish content that's unlawful, hateful, or infringes someone else's rights;
- get around limits or security, scrape, reverse engineer or overload the service, or get into other people's accounts;
- make the AI produce harmful content or mislead people with it;
- sell or share your login.
We may remove content, limit features, or suspend accounts that break these rules.
11If you book through a Daynup page
Booking pages are run by the businesses that use Daynup. The business sets its services, prices, times and rules, and your booking is an agreement between you and the business. Use your own name and phone number, and only book times you mean to keep. You can move or cancel from your booking link, within the business's rules.
Some pages have AI help that answers questions about free times, prices and your bookings. It can be wrong and can't book anything, so if something matters, check with the business. Our Privacy Policy explains how your details are handled.
12Availability and beta features
We work hard to keep Daynup running and to keep improving it, so features may change, and Daynup may sometimes be unavailable, for example during maintenance or when a provider has an outage. Features marked beta are offered as they are, and may change or end. Some parts of Daynup rely on others, such as Apple, Google, WhatsApp and phone carriers, which we don't control.
13Ending and deleting your account
You can stop using Daynup and delete your account at any time in the app: Your page → Delete account. If you own the business, your booking page closes right away and its upcoming bookings are cancelled. Your account and business data are deleted or anonymised after 30 days. Signing in again before then brings your account back, though cancelled bookings stay cancelled. If you're on someone else's team, you leave it. Remember to cancel your subscription separately.
We may suspend or close an account that seriously or repeatedly breaks these terms, puts other people at risk, or when the law requires it. Unless the law or someone's safety stops us, we'll tell you why and give you a chance to put it right or to ask for a copy of your data.
14Disclaimers and liability
Daynup is provided "as is" and "as available". To the extent the law allows, we don't promise that it will always be available or free of errors, that it suits your business, that AI answers are correct, or that every message will be delivered. We aren't responsible for no-shows, for your clients' conduct, or for the services you provide.
To the extent the law allows, we aren't liable for indirect, incidental, special or consequential losses, or for lost profits, revenue, bookings or data. Our total liability for any claim about Daynup is limited to the greater of what you paid us in the 12 months before the claim and US$100.
If someone brings a claim against us because of your services, your content, your messages to clients, or your breach of these terms or the law, you'll cover our reasonable costs of it, to the extent the law allows.
Nothing in these terms limits liability that the law doesn't allow to be limited, such as for fraud, or for death or personal injury caused by negligence, or takes away your rights as a consumer.
15Changes to these terms
When we change these terms, we'll update the date at the top. For important changes, we'll tell you in the app or by email before they take effect. If you keep using Daynup afterwards, the new terms apply. If you don't agree with them, you can cancel and delete your account.
16Law and disputes
These terms are governed by the laws of [Governing law]. Disputes go to the courts of [Courts / venue], unless the law where you live gives you the right to bring them there. Before going to court, please write to us. Most things can be sorted out quickly.
17General
These terms and our Privacy Policy are the whole agreement between us about Daynup. Enterprise customers may have signed terms of their own, which come first. If part of these terms can't be enforced, the rest still applies. If we don't enforce something straight away, we haven't given up the right to. You can't transfer these terms to someone else without our agreement. We may transfer them to a company that takes over Daynup, and we'll tell you if we do. Neither of us is responsible for delays caused by events beyond reasonable control. If you got Daynup from the App Store, Apple's standard licence for apps also applies.
